بتاريخ ٢٧ – ٢٨ نوفمبر ٢٠٢٥ حضر كل من كندال موسى عضو اتحاد المحامين الكورد و رشيد عيسو ممثلاً عن الاتحاد مؤتمر جنيف للاقليات في دورته ال ١٨.

السيدات والسادة،

يُعدّ الشعب الكوردي من أقدم شعوب المنطقة، ويزيد تعداده على خمسين مليون نسمة يعيشون على أرضه التاريخية، ورغم ذلك ما يزال محروماً من حقه الطبيعي في تقرير المصير أسوةً بسائر الشعوب.
وعلى الرغم من مكانته كإحدى أكبر القوميات المحرومة من هذا الحق، لا يزال المجتمع الدولي يحصر تمثيله في إطار “الأقليات”، في تجاهل لكونه قومية أصيلة تستحق اعترافاً كاملاً.

نتقدم إليكم اليوم لعرض جانب من الانتهاكات الجسيمة التي يتعرض لها المدنيون الكورد في سوريا، ولا سيما في عفرين، وهي انتهاكات تطال الحقوق الأساسية وتشكل خرقاً واضحاً للقانون الدولي الإنساني.

ففي عام 2018 تعرّضت عفرين لعملية تهجير قسري عقب سيطرة فصائل مدعومة من تركيا، ما أدى إلى اقتلاع عشرات الآلاف من ديارهم، في مخالفة صريحة للمادة 49 من اتفاقية جنيف الرابعة التي تحظر النقل القسري للسكان.

كما وثّقت منظمات دولية عديدة انتهاكات ممنهجة، من أبرزها:

• الاستيلاء غير المشروع على الممتلكات.
• ⁠ الاعتقالات التعسفية.
• ⁠ فرض الإتاوات.
• ⁠ الترهيب والمعاملة القاسية.
• ⁠ التهجير المنظّم بهدف التغيير الديمغرافي.

إن استمرار هذه الممارسات يهدّد السلم الأهلي، ويستدعي تدخلاً دولياً عاجلاً لضمان حماية المدنيين.

وعليه، نوصي بما يلي:

1- تعزيز الحقوق القومية والثقافية للشعب الكوردي باعتباره مكوناً أصيلاً من مكوّنات سوريا، وضمان ترسيخها في أي دستور مستقبلي.
2- حماية المدنيين في المناطق الكوردية وسائر أماكن وجودهم.
3- ضمان عودة السكان الكورد إلى ديارهم في عفرين وسري كانيه وكري سبيه دون قيد أو شرط.

السيدات والسادة،
إن مستقبل سوريا لن يستقر دون احترام حقوق جميع مكوّناتها، وفي مقدمتها الشعب الكوردي. فالعدالة والمساواة والاعتراف المتبادل هي الأساس المتين لبناء سلام مستدام وسِلم أهلي راسخ.

Ladies and gentlemen,

The Kurdish people are among the oldest peoples in the region, with over fifty million people living on their historic land. Despite this, they are still denied their natural right to self-determination, like all other peoples.
Despite its status as one of the largest nationalities deprived of this right, the international community still limits its representation to “minorities”, ignoring the fact that it is an authentic nationality that deserves full recognition.

Today we come to you to present some of the serious violations to which Kurdish civilians are exposed in Syria, especially in Afrin, which are violations of basic rights and constitute a clear violation of international humanitarian law.

In 2018, Afrin was subjected to a forced displacement operation following the control of factions supported by Turkey, which led to the uprooting of tens of thousands from their homes, in clear violation of Article 49 of the Fourth Geneva Convention, which prohibits the forced transfer of population.

Many international organizations have also documented systematic violations, most notably:

• Unlawful seizure of property.
• Arbitrary arrests.
  Imposing royalties.
• Intimidation and cruel treatment.
• Organized displacement for the purpose of demographic change.

The continuation of these practices threatens civil peace and requires urgent international intervention to ensure the protection of civilians.

Therefore, we recommend the following:

1- Promoting the national and cultural rights of the Kurdish people as an integral component of Syria, and ensuring that they are enshrined in any future constitution.
2- Protecting civilians in Kurdish areas and all their locations.
3- Ensuring the unconditional return of the Kurdish population to their homes in Afrin, Sari Kaniye and Kri Sebih.

Ladies and gentlemen,
Syria’s future will not be stable without respect for the rights of all its components, especially the Kurdish people. Justice, equality and mutual recognition are the solid foundation for building sustainable peace and solid civil peace.
